WAIVER/RELEASE OF LIABILITY By the execution of this Release, the Borrower agrees that the Provider and/or WONACE Medical Supply shall not be liable for any damages arising from personal injuries sustained by the Borrower or anyone under the Borrower’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by the Provider or WONACE Medical Supply. The Borrower assumes full responsibility for any such injuries or damages that may occur, and further agrees that the Provider and/or WONACE Medical Supply shall not be liable for any loss or theft of personal property. The Borrower specifically agrees that the Provider and/or WONACE Medical Supply shall not be responsible for such injuries, damages, loss, or theft, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY THE PROVIDER AND/OR WONACE MEDICAL SUPPLY, whether such negligence is present at the signing of this Release or takes place in the future. LIABILITY TO THIRD PARTIES The Borrower hereby agrees that he/she will indemnify and hold harmless the Provider and/or WONACE Medical Supply for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators of other equipment under the Borrower’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by the Provider and/or WONACE Medical Supply, even if such damages arise out of the negligence or fault of the Provider and/or WONACE Medical Supply. DAMAGES & LATE RETURNS WONACE Medical Supply and/or the Provider may keep the Borrower’s credit card on file to cover any late return charges, excessive equipment damages, or equipment loss. In addition, some Providers may require you to put down a refundable security deposit at the time of equipment delivery or pickup as additional security. In the event the Borrower has purchased the Equipment Protection plan available through WONACE Medical Supply, the Borrower will not be liable for the damages covered under the Protection Plan. The Borrower’s credit card shall not be charged if the equipment is not damaged, lost, or returned earlier than the agreed date by the Borrower. If the Provider charges a security deposit, they are bound to return it immediately upon return of the rental goods as per the Partner agreement WONACE Medical Supply has signed with its Providers. WONACE Medical Supply and/or the Provider will inform the Borrower of any additional charges prior to charging the Borrower’s credit card. ACKNOWLEDGMENT OF WAIVER AND RELEASE The Borrower states that he/she has had sufficient time to review this Waiver and Release agreement and to ask any questions associated with said Release. The Borrower further states that he/she has carefully read the foregoing Waiver and Release, knows the contents thereof, and has electronically agreed to this Release by reserving the item(s) via the WONACE Medical Supply website or mobile app, as his/her own free act. The Borrower warrants that he/she is aware that he/she may rent, operate, or use the equipment from another rental facility, but has chosen to rent, operate, or use equipment from the Provider and/or WONACE Medical Supply with the knowledge that signing this Release is a requirement for reservation, rental, operation, and use of said equipment. The Borrower further warrants that he/she is fully aware that he/she is waiving any right he/she may have to bring a legal action to assert a claim against the Provider and/or WONACE Medical Supply for WONACE Medical Supply’s or the Provider’s negligence or any other claim or dispute arising as a part of this rental transaction. SEVERABILITY If any provision of this Agreement shall be held to be invalid or unenforceable, such provision shall be stricken, and the remainder of the Agreement shall remain in full force and effect to accomplish the intent and purpose of the parties. The customer shall hold WONACE devoid of any further responsibilities for the damages. Shipping costs are non-refundable. If an incorrect product has been delivered, WONACE will arrange for free return shipping. Once the return has been received, we will send you a replacement product without any additional shipping charges. Products purchased from WONACE may be returned within a period of 5 days from the date of delivery. NO RETURNS on OPEN and USED. All used, refurbished, demo medical equipment is a Final Sale. These products are not refundable or exchangeable without prior written permission from WONACE. Items specifically designated as being on Back-Order may be returned within a 5-day period from the date of delivery. To return merchandise for credit or replacement, please contact us. Once, WONACE receives the submission, you will be contacted with return instructions. All returned products must be in their original packaging. Packages without a WONACE approval will not be accepted and will be returned to the customer. Returns that have suffered physical damage during use by the customer or during transit back to WONACE will not be accepted for any reason. All returns are subject to a minimum 40% restocking fee. The restocking fee will not apply to orders incorrectly fulfilled by WONACE. Credit for returned items will only be issued once the return has been received, inspected, and processed by the shipping/ receiving department, approximately 5 days from the date of receipt. Customers whose returned merchandise arrives with missing parts or components will be charged for the missing parts in addition to the restocking fee. Refunds will be issued back to the purchasing credit card or with a company check, unless otherwise instructed by the customer. An order cancellation fee of 10% will apply, if an order is cancelled by the customer after the order has been processed. Most orders are processed the day or order placement. A full-refund will be given if the order has not yet been processed at the time of the cancellation. Returns for MS3C brand products; such as medical carts, wheelchairs, Rollators, Walkers, Evacuation chairs and EMS stretchers are subject to up to 40% restocking fee. Customer is also responsible for return shipping. Made-to-Order products such as; power tables, exam tables, medical cabinets, shelving, sinks, curtain track, whirlpools, etc. are not returnable and are nonrefundable. Once a Made-to-Order item has been put into production, a cancellation fee of up to 40% may apply. Once these products have been shipped, they cannot be returned to MSEC and may only be repaired or returned to the manufacturer at the manufacturer’s discretion. All written product warranties will be honored by the manufacturer. Made-to-Order products may take up to several weeks to ship out. Any product which has been worn or came into contact with the human body is not returnable or refundable. Items such as pillows, diapers, mattresses, braces, hand splints, chair cushions and other medical products are single-use patient items and cannot be returned due to regulations governing the resale of these products. Broken or partial cases cannot be returned. Due to the nature of items marked Specials or On Sale, returns for credit or replacement will be limited to those products that are damaged or defective upon delivery. Due to stock limitations, replacements for Specials or On Sale items may limited. Defective medical products will be exchanged with the same type of products ordered. Default on any portion of the payment be it either by check, credit card or any other legal and acceptable means will begin to accrue interest on the outstanding amount at the rate of two and one-half (2.5%) percent per month. All related fees and expenses, including; legal, collections, travel, accommodations, etc. will become the responsibility of the undersigned or the organization noted below. WONACE is not liable for shipments made to us. We recommend that our customers use reputable shipping companies such as; UPS, FedEx, DHL or the U.S. Postal Service with good packaging (original packing preferred) and full insurance paid.
